This Agreement governs your use of Aarting.com and the service that it provides. Aarting permits customers that have an appropriate relationship either with: (i) institutions of higher learning, fraternal organizations, honor societies and other collegiate groups (collectively, "Institutions"); (ii) corporations and small businesses; (iii) elementary and secondary schools; (iv) non-profit organizations and charities; or (v) other organizations to design and purchase custom merchandise properly describing that relationship. Additionally, it also permits people within those organizations to sell prints and original works of art to individuals in order to fund, raise and make money. You understand that by using Aarting.com and it's services, you have agreed to the terms and conditions of this Agreement and you agree to use the Site and the Service solely as provided in this Agreement.
Aarting.com works hard to ensure that all our campaigns are printed to a high-quality & shipped on time and accurately. Aarting.com accepts returns and will issue a full refund within 30 days of the end of the campaign if customers are disappointed with their order for any of the following reasons: The print itself is flawed or ripped; The quality of the printing is poor; Or if the final product is materially different than the design presented in the campaign. Intellectual Property Rights
Aarting.com is the owner of the Aarting trademark; other trademarks made available through this Site, including logos, slogans, color schemes and design trademarks, are licensed for use by Aarting.com from Institutions and other third
parties (the "Licensed Marks"). By using the Aarting.com Site, you agree to limit your use of Licensed Marks to uses that are directly related to such third parties and to comply with any restrictions or conditions imposed on the use
and access of the Licensed Marks by the third parties. Aarting.com will notify you if it is discovered that your usage has violated such terms.
Aarting.com provides some sample artwork that is trademarked and copyrighted. If you design a shirt with our designer and you use the graphical materials the designer provides, you don’t own the rights to the design (sorry).
Additionally, Aarting.com has the sole discretion to reject any campaign that it considers defamatory, obscene, offensive, profane, slanderous (according to standards established by the FCC), portraying irresponsible use of alcohol or other substances, advocating persecution based on gender, age, race, disability, sexual orientation or national origin, containing explicit sexual content or is otherwise inappropriate for Aarting.com production. Aarting.com reserves the right to terminate any campaign at will.
You agree to not use the Aarting.com to create and sell any material that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or that infringes on any patent, trademark, trade secret, copyright or other proprietary rights of any third party.
You agree to defend, indemnify and hold Aarting.com and its affiliates harmless from and against any and all claims, damages, costs and expenses, including reasonable attorneys' fees, arising from or relating to your use of Aarting.com’s site and the service, your violation of this agreement, or your violation of any rights of another.
Aarting.com provides an automated internet-based service to users, which they use to design and sell prints and original works of art. We contractually prohibit our users from using the service to sell merchandise that infringes third party intellectual property rights (such as copyright, trademark, trade dress and right of publicity). We encourage intellectual property rights owners to contact us if they believe that a user of our service has infringed their rights. If you let us know that your rights are being infringed by one of our users we will (in our discretion) require that the user's content is removed from products and, if the user continues to infringe your rights (or infringes the rights of others) terminate the user's access to our services.
If you believe that your intellectual property rights have been infringed by an Aarting.com User, please provide our Intellectual Property Rights Agent with a notification that contains the following information:
1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright or other rights that have been allegedly infringed.
2. The URL or product number(s) used in connection with the sale of the allegedly infringing merchandise.
3. Identification of the copyright, trademark or other rights that have been allegedly infringed.
4. Your full name, address, telephone number(s) and email address(es).
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the rights owner, its agent or the law.
6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright or other right that is allegedly infringed.
